1. Introduction

Welcome to VibeAudit. These Terms and Conditions govern your use of our website located at https://vibeaud.it and our security scanning services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Please read these Terms carefully before using our Service. Your continued use of the Service constitutes acceptance of these Terms and our Privacy Policy.

2. Communications

By creating an account on our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

We may use your email address to send you service-related notices, including security scan results, vulnerability alerts, and important updates about your account.

3. Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly or annually, depending on your selected plan).

At the end of each billing cycle, your subscription will automatically renew under the same conditions unless you cancel it or VibeAudit cancels it. You may cancel your subscription renewal through your account settings or by contacting us at hello@vibeaud.it.

A valid payment method is required to process payments for your subscription. You must provide current, complete, and accurate billing information. You must promptly update all information to keep your payment method current.

4. Free Trial

VibeAudit offers a free tier that allows you to scan 1 application with up to 5 security scans per month and analysis of up to 100 files.

At any time and without notice, VibeAudit reserves the right to modify or discontinue the free tier or any feature provided under the free tier.

When your free scans are exhausted, you will be prompted to upgrade to a paid subscription to continue using the Service.

5. Fee Changes

VibeAudit, at its sole discretion and at any time, may modify subscription fees for the paid plans. Any subscription fee change will become effective at the end of the then-current billing cycle.

VibeAudit will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.

Your continued use of the Service after the subscription fee change comes into effect constitutes your agreement to pay the modified subscription fee amount.

6. Fair Usage Policy

Our Service is subject to fair usage limits to ensure quality and availability for all users. Each subscription tier has specific limits on:

• Number of applications you can monitor
• Number of security scans per month
• Maximum number of files that can be analyzed per scan

We reserve the right to suspend or terminate accounts that exhibit patterns of abuse, including but not limited to:

• Excessive API requests or automated scanning beyond reasonable use
• Attempting to circumvent usage limits
• Using the Service in a way that negatively impacts other users

7. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To exploit, harm, or attempt to exploit or harm minors in any way
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate VibeAudit, a VibeAudit employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
• To scan applications or code that you do not own or have permission to scan
• To use the Service to develop competing security scanning products or services
• To reverse engineer, decompile, or disassemble any portion of the Service

Additionally, you agree not to use the Service to scan for or exploit vulnerabilities for malicious purposes. Our Service is intended for defensive security purposes only.

8. No Use By Minors

The Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using the Service, you warrant and represent that you are at least eighteen (18) years of age and have the legal capacity to agree to these Terms.

If you are under 18 years of age, you are not permitted to use or register for the Service.

9. Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We use OAuth authentication with GitHub and Google for secure account access. You are responsible for maintaining the security of your linked authentication accounts.

10. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of VibeAudit and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of VibeAudit.

You retain all rights to your code and applications that you scan using our Service. We do not claim ownership of your code. We only access your code temporarily to perform security scans and do not store it permanently.

11. Error Reporting and Feedback

You may provide us directly at hello@vibeaud.it with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service ("Feedback").

You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) VibeAudit may have development ideas similar to the Feedback; and (iii) the Feedback does not contain confidential information or proprietary information from you or any third party.

12. Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by VibeAudit, including but not limited to GitHub and Supabase.

VibeAudit has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that VibeAudit shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.

13. Disclaimer Of Warranty

THESE SERVICES ARE PROVIDED BY VIBEAUDIT ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIBEAUDIT MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN.

YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.

VIBEAUDIT DOES NOT GUARANTEE THAT OUR SECURITY SCANS WILL DETECT ALL VULNERABILITIES IN YOUR APPLICATION. SECURITY SCANNING IS A TOOL TO ASSIST IN IDENTIFYING POTENTIAL ISSUES, BUT IT DOES NOT REPLACE PROFESSIONAL SECURITY AUDITS OR GUARANTEE THAT YOUR APPLICATION IS SECURE.

NEITHER VIBEAUDIT NOR ANY PERSON ASSOCIATED WITH VIBEAUDIT MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

14. Limitation Of Liability

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD US AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS' FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.

IN NO EVENT SHALL VIBEAUDIT BE LIABLE FOR ANY DAMAGES RESULTING FROM SECURITY BREACHES OR VULNERABILITIES IN YOUR APPLICATION, WHETHER OR NOT SUCH VULNERABILITIES WERE DETECTED BY OUR SERVICE.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO VIBEAUDIT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us at hello@vibeaud.it.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

17. Changes To Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of the Service, or the entire Service, to users, including registered users.

18. Amendments To Terms

We may amend these Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
